These Terms of Service ("Terms") govern your access to and use of the services provided by BroadwayVoIP LLC ("BroadwayVoIP"). By using our services you agree to these Terms.
1. Services
BroadwayVoIP provides Voice over IP services including DID numbers, SIP trunking, toll-free numbers, hosted PBX and wholesale voice termination. Services are subject to availability and applicable regulations.
2. Accounts
You are responsible for maintaining the confidentiality of account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
3. Billing and payment
All fees are billed in USD via credit or debit card unless otherwise agreed. Usage-based charges are billed in arrears based on our CDRs.
4. Acceptable use
You may not use the services for unlawful, fraudulent, spam, robocalling or high-risk destinations without written approval. See the Acceptable Use Policy.
5. Service levels
We target 99.99% platform availability. Enterprise plans include a written SLA. Credits, where applicable, are the sole remedy for downtime.
6. Termination
Either party may terminate for material breach with written notice and a reasonable cure period. We may suspend service immediately for fraud, abuse or non-payment.
7. Limitation of liability
To the maximum extent permitted by law, BroadwayVoIP is not liable for indirect, incidental or consequential damages. Total liability is limited to the fees paid in the three months preceding the claim.
8. Governing law
These Terms are governed by the laws of the State of Colorado, USA.
